Shoplifting is a theft crime. You will face the same penalties as you would for any other theft charge.
According to the Louisiana State Legislature, penalties for shoplifting will typically focus on the value of the goods. The court figures the value based upon the retail price of the items.
The majority of shoplifting cases for be for goods under $1,000. If this is what you are facing, then the potential sentence of for up to six months in jail. You also may face a fine of up to $1,000.
There is an exception. If you have previous charges for a theft crime, then the jail time increases to up to two years and the potential fine goes up to $2,000.
The next step up will bring potential fines of up to $3,000. You may also face up to five years in prison.
At this level of property value, you will face up to 10 years of incarceration. The fine also increases to up to $10,000.
The highest level of punishment is for property valued at over $25,000. At this point, you could go to prison for up to 20 years. The fine potentially could be as much as $50,000.
You should keep in mind that all levels, not just the lowest level, will have harsher sentences for repeat offenses. For the other levels, though, you will be more likely to get the maximum punishment if you have previous charges. If you do not, then the court may be more lenient. However, it is always up to the judge’s discretion within the sentencing guidelines as to what to impose.
